Rethinking dispute resolution in sport after Semenya and Seraing

IBA Annual Conference Copenhagen 2026

Speaker Event IBA Annual Conference Copenhagen 2026 Description

This session explores the future of dispute resolution in international sport, focusing on the role of the Court of Arbitration for Sport (CAS) in light of two landmark decisions: the European Court of Human Rights' judgment in Semenya v. Switzerland and the Court of Justice of the European Union's ruling in Royal Football Club Seraing v. FIFA.

These decisions challenge fundamental assumptions underlying the current system of sports arbitration and raise important questions regarding arbitral autonomy, human rights, competition law and public policy. The speakers will examine whether the existing CAS framework continues to provide a legitimate and effective mechanism for resolving sports disputes, or whether reforms are needed to strengthen its independence, accountability and credibility.

The discussion will also consider the broader implications of these developments for international arbitration and other forms of private dispute resolution beyond the sporting context.

This session will be of particular interest to practitioners and academics working in arbitration, sports law, competition law and international dispute resolution, as the issues addressed have significance well beyond the world of sport.
