Gleiss Lutz represents Deutsche Bundesbank in request for preliminary ruling by the Federal Constitutional Court with the CJEU

Gleiss Lutz has represented Deutsche Bundesbank in preliminary ruling proceedings on the ECB’s Public Sector Purchase Program (PSPP). The Federal Constitutional Court’s request was filed in connection with several constitutional complaints. In particular, the complainants had asserted that the ECB’s acts had been rendered ‘ultra vires’ and were not compatible with German constitutional law. Moreover, they had asserted a breach of competences as well as a violation of the prohibition of monetary state financing.

The case was handled by Ulrich Soltész (lead), Christian von Koeckritz (both partner, EU law, Brussels) and Benjamin Herz (banking and regulatory, Frankfurt). Gleiss Lutz has been extensively involved in EU law matters, with a focus on litigation before the Luxembourg Courts, for many years.
