Gleiss Lutz advises Burgenlandkreis on the insolvency plan proceedings of Klinikum Burgenlandkreis GmbH

Gleiss Lutz has represented the Burgenlandkreis administrative district in the insolvency plan proceedings of Klinikum Burgenlandkreis GmbH. SRH Kliniken GmbH will take over the insolvent Klinikum Burgenlandkreis GmbH. The clinic has around 1,500 employees and takes care of approximately 68,000 patients each year.

A Gleiss Lutz team was involved in the bidding process for the insolvent Burgenland clinic as well as the negotiations with possible cooperation partners, including SRH Kliniken GmbH, to safeguard the continued existence of the clinic in a joint venture that is (partly) backed by the municipality. Gleiss Lutz also advised on the acquisition of a part of the clinic by the Burgenlandkreis as well as on questions regarding public services obligations. 

Before SRH Kliniken GmbH can take up its stake – as part of the insolvency plan – the creditors’ meeting still has to give its consent. The acquisition of the youth welfare service by the Burgenlandkreis can be executed immediately. The parties have agreed not to disclose the purchase prices.

Gleiss Lutz regularly advises public contract authorities as well as on corporate acquisitions as part of insolvency plan proceedings in the clinic sector. In 2018, the firm for example advised the family-owned holding company Porterhouse Group AG on the acquisition of the insolvent clinic group Paracelsus.
