M&A Gesprächskreis: CFIUS and Foreign Investment Controls in the EU – the Trump Factor in cross-border M&A Transactions

Our keynote speakers, Mark Plotkin and David Fagan from Covington & Burling, Washington, DC, will discuss emerging developments and trends that have affected the review process of the Committee on Foreign Investment in the United States (CFIUS). Mark and David are the leading CFIUS experts according to Chambers USA.

A presentation by our partner and foreign investment expert Jacob von Andreae will follow, elaborating on the German foreign investment regime and potential developments in foreign investment control mechanisms.

As national-security review processes similar to CFIUS are gaining prominence in other countries, we will close this event with a panel discussion moderated by Christian Cascante/Ralf Morshäuser. Mark, David and Jacob will be joined by French foreign investment expert Jean-Gabriel Flandrois from Gide Loyrette Nouel, Paris. With the perspectives of two key EU-jurisdictions and the U.S. and taking into account new initiatives to strengthen the protection of national key technology and to promote international reciprocity in cross-border M&A transactions, we want to discuss how to best cope with foreign investment control risks and what you can do to increase deal certainty.
