Data protection in the healthcare sector: EU General Data Protection Regulation and healthcare digitalisation

The General Data Protection Regulation of the EU (GDPR) will take immediate effect in Germany as of 25 May 2018. The GDPR represents a uniform European data protection law that will force private companies and public bodies to make considerable adaptations. For the health sector, the Regulation also makes it possible for the national legislator to create or maintain its own data protection rules and specifications by means of “opening clauses”. In Germany the responsible ministries are expected to present such draft legislation at the beginning of February.
