Gleiss Lutz advises voestalpine AG as leniency applicant in the FCO “special steel cartel” proceedings

On 12 July 2018 the Federal Cartel Office fined six manufacturers of special steel, a trade association and ten individuals a total of approx. 205 million Euros for price fixing agreements and exchanging competitively sensitive information. Investigations into four other companies and a trade association are still ongoing.

voestalpine AG, with its registered office in Linz (Austria), had initiated the proceedings together with Gleiss Lutz by filing a leniency application. The violations were discovered within the group as a result of routine audits, which are regularly conducted as part of the company’s compliance organisation with the support of Gleiss Lutz. The origins of the events lie in the distant past. Once identified, they were fully investigated and disclosed to the Federal Cartel Office.

As a leniency applicant voestalpine AG was not fined.

voestalpine AG was represented by Dr. Ulrich Denzel (partner, lead) and Dr. Miriam Schmidt (both competition/antitrust, Stuttgart).
