Reliance on IT is increasing all the time and the costs are rising, too. This means that there is an ever growing demand for advice that is not only legally sound, but also has an eye to the costs and benefits for the client – whether it is a matter of drafting standard contracts or advising on complex IT projects: Broad experience is required, coupled with creativity and negotiating skills.
Gleiss Lutz covers the entire spectrum, from the development of software to the consideration and assessment of insolvency issues. We develop contracts for the sale or purchase of IT (software, hardware, databases or systems), for the maintenance and support of systems and for the deposit of software. Further, projects like the introduction of new IT systems, intragroup computer system restructuring measures, joint development projects or the outsourcing of IT or business processes (BPO) are just some of the focuses of our work. Our expertise also includes providing our clients with qualified and efficient advice in crisis situations, and representing them in court. We have extensive litigation experience in this field.
For many years, we have been following the development of e-business with all its many and varied facets. Our work has concerned fundamental matters like the registration, securing and defence of domains worldwide (including WIPO proceedings), the establishment of joint platforms, the sale of goods and services, extensive web audits, compliance with statutory duties to provide information and data protection regulations, the assessment of links and frames, and disputes with competitors or consumer associations. Our expertise is also in demand, however, for more complex problems, such as questions of liability in connection with on-line bidding services and auction houses, or the assessment of electronic press reviews, issues concerning on-line gambling, DRM and statutory remuneration claims, certification services and, last but not least, the complicated data protection requirements.
Our work naturally does not stop at Germany’s borders ‑ e-business and the Internet know no borders. Gleiss Lutz is able to provide foreign clients with the support they need for their operations in Germany, and, together with our colleagues in the IT departments of our alliance partners Herbert Smith and Stibbe as well as other leading IT law firms in Europe and in the USA, we also advise clients cross-border.
