Today, companies face ever-increasing compliance requirements. Press reports abound of contraventions and failings on the part of management. This brings the matter to the attention of the public, prosecuting authorities and competitors and may damage a company’s reputation and result in record fines and damages claims.

Having effective internal controls in place as well as measures aimed at detecting violations early on – before others do – will protect the company and reduce the management’s liability risk. Gleiss Lutz’ interdisciplinary compliance team is able to provide assistance on all the relevant aspects.

Our services encompass the particularly sensitive areas of antitrust, criminal law, employment and data protection, as well as corporate law. We develop customised compliance systems and help implement them within the company. We offer seminars and online training sessions to train management and employees in the relevant statutory requirements and raise their awareness of compliance issues. In case of breach of duty on the part of management, we provide extensive advice on D&O insurance, including who is insured, for how much, and against what. In especially high-risk sectors, we offer screenings and audits for optimal risk assessment and minimisation that can be instrumental in detecting weak spots and flaws in corporate structures or existing compliance systems – after all, case-specific internal investigations can flag up legal breaches within the company and lay the groundwork for possible litigious proceedings.

We have extensive experience in dealing with antitrust and criminal authorities and courts, and, if worst comes to worst, we will assist in defending against damages claims levelled at the company and its management. We draw on the specialist knowledge of our lawyers across various practice areas to provide tailored client solutions. In cross-border cases, we work hand in hand with colleagues at our own European offices as well as with a network of best-friend law firms in Europe and elsewhere. This makes us a one-stop shop for the complex field of compliance and internal investigations.
