Public contracts involve the movement of immense sums – a gigantic market that is increasingly being opened to competition as a consequence of European legislation. With growing legal regulation, the potential for conflict grows as well. Bidders fight for market access, procedures for awarding contracts are examined in respect of their legality. Gleiss Lutz’s team for public procurement law advises both public contract awarders and bidders in this sensitive and complicated field. In demand are pragmatic and legally secure solutions. The breadth of our practice extends through the entire range of branches that bid for public contracts including the construction industry, the area of waste disposal, and the health, traffic and IT sectors.
Public procurement law is an extraordinarily dynamic area of law – shaped by the constant further development of legal rules and regulations, but also by extraordinarily dynamic case law. Our advice in this area has been at the cutting edge of legal development and we are often involved in shaping this development. Again and again, our law firm is commissioned for expert reports on current legal problems, argues cases involved in leading decisions and engages in current debates by means of publications and lectures.
A clear emphasis of our public procurement law practice lies in representation in verification procedures. Here we are active on behalf of applicants, contract awarders or summoned companies. We have extensive experience in contentious proceedings.
