Gleiss Lutz advises banks, groups as well as large and medium-sized companies in Germany and abroad on all areas of banking and financial law. Professional specialisation within the field, personal engagement and individual advising form the basis for innovative solutions and successesful negotiations. In international transactions, we utilise a close network of cooperating, specialised lawyers in all economic and financial centres, particularly in the U.S.
A focus of our activity is providing legal assistance to banks and companies with respect to syndicated loans, in particular as part of the financing of acquisitions. Our banking lawyers work hand in hand with their colleagues from tax law and corporate law. In this way, legal questions arising from all areas of law can be solved quickly and practically.
In the area of asset finance (leasing, factoring, securitisation), we represent banks, leasing companies and other financial enterprises, as well as industrial concerns. We advise on the financing of assets of all types, e.g., airplanes, railway trains and fleets, automobile production plants and power stations. We design – not only within Germany but also across borders – “sale and lease-back” and “lease and lease-back” transactions, as well as the purchase and sale of large leasing portfolios. The tax-optimised structuring of these transactions represents a focus of our activity.
We advise banks and enterprises on all aspects of financial service regulation. We conduct internal investigations, for example in cases of suspected insider dealing, market manipulation or money laundering, and represent our clients against the supervisory and prosecuting authorities. We advise on the consequences of such conduct wiht regard to employment law and civil liability and, where appropriate, enforce liability claims against the responsible individuals.
