Beginning with the development of a product, Gleiss Lutz ensures, in cooperation with our clients’ technical experts, that the requirements of product liability are adhered to and used to increase the quality standard of the products. We define the legal framework for development, give advice on the conclusion of development agreements, structure supply relationships and influence the presentation of the product in regard to product liability law. Upon request, we will combine this advice with legal-risk analysis and suggestions for insurance.
We are well aware of just how much a company’s reputation is determined by how it deals with questions of product liability. Therefore, we gear our advice towards practical communication within the market, for example in the design of instruction manuals, but also in providing information concerning recalls.
Negotiations with the authorities will intensify as a consequence of the planned changes to the Product Safety Act. If companies are confronted with enquiries from the authorities or with liability-related demands from consumers based on purported product defects, we will assist with all the necessary actions. We advise on warnings and recalls of all kinds, always trying to minimize the damage to the company’s reputation. If a lawsuit is unavoidable, we will maintain intensive cooperation with our clients’ technical experts and, if necessary, with external consultants. We are used to communicating with technical experts in a wide variety of fields and to making the legal issues understandable for them. In so doing, we utilise the sector-specific knowledge we have acquired over many years, in particular of the automobile industry and its suppliers, as well as in the areas of electronics, food, medicine and all types of consumer goods.
