For decades, Gleiss Lutz has managed large, medium-sized and small trademark portfolios of companies of all sizes. Over 20 specialists are currently active in this area of our practice managing trademarks in over 190 countries. In countries outside of Germany, we work together with leading trademark law firms.
The spectrum of our activites ranges from strategic consultation regarding brand creation and selection, to comprehensive support during the prosecution stage as well as subsequent trademark surveillance. In our trademark practice, we naturally also take account of other areas of law, such as competition law and product regulation. These considerations are important in the selection of suitable trademarks and for the subsequent defence and enforcement of trademark rights. We also advise our clients in the area of contracts, in particular with regard to negotiating, such as licensing, merchandising, and coexistence agreements.
We have acted for our clients in numerous trademark conflicts nationally and internationally before German and European authorities and courts. We have at our disposal wide-ranging know-how both for the handling of such conflicts and regarding dispute settlement techniques. Trademark conflicts in particular – if no solution can be found quickly and creatively – usually have an international character and thus the tendency to become time consuming and expensive.
Professional clearance searches represent a further focus of our work. We carry out online searches into all types of trademarks, such as German trademarks, internationally registered trademarks and Community trademarks, since trademark data are retrievable online for an ever encreasing number of countries.
We also offer Internet searches with search engines in order to uncover additional risks that cannot always be discovered via classic trademark searches. This also includes trademarks in countries and territories that are not yet accessible via online trademark searches. Of course, we also carry out searches in the area of trade names and copyrights.
We have also worked for many years intensively in the area of domains regarding domain management, availability searches and the settlement of global conflicts.
