For decades, Gleiss Lutz has managed large, medium-sized and small trademark portfolios of companies of all sizes. Over 20 specialists are currently active in this area of our practice managing trademarks in over 190 countries. In countries outside of Germany, we work together with leading trademark law firms.
The spectrum of our activity ranges from strategic consultation regarding trademark creation and selection, to comprehensive support during the application procedure and to monitoring for interference. In our trademark practice, we naturally also take account of other areas of law, such as competition law and product law. These considerations are important in the selection of suitable trademarks and for the subsequent defence and enforcement of trademark rights. We also offer high-quality, practical advice in the area of contract design, in particular with regard to negotiating and formulating agreements, such as licensing, merchandising, differentiation and coexistence agreements.
We are active for our clients in numerous trademark conflicts nationally and internationally before German and European authorities and courts, and we thus have at our disposal wide-ranging know-how both for the handling of such conflicts and with regard to the techniques and varieties of dispute settlement. Trademark conflicts in particular – if no solution can be found quickly and creatively – usually have an international character and thus the tendency to become time consuming and expensive.
Professional and extremely quick searches in the area of trademarks represents a further focus of our work. We carry out online searches into all types of trademarks, such as German trademarks, internationally registered trademarks and Community trademarks, since trademark data are retrievable online for an ever encreasing number of countries.
Parallel to this we offer Internet searches with search engines in order to uncover additional risks of interference that cannot always be discovered via classic trademark searches. This also includes trademarks in countries and territories that are not yet accessible via online trademark searches. Of course, we also carry out searches in the area of trade names and copyrights.
Closely related to trademark protection is domain consultation, in which we have worked intensively for many years – with regard to domain management, the conduct of searches and the settlement of conflicts worldwide.
